CCPA Issues Notices to E-commerce Platforms for Illegal Sale of Walkie-Talkies
The Central Consumer Protection Authority (CCPA) has issued notices to 13 digital marketplaces, including top platforms like Amazon and Flipkart, for the illegal sale of walkie-talkie devices. These actions come amid rising India-Pakistan tensions, as the sale of such communication equipment without proper licensing and frequency disclosure is seen as a threat to national security.
Why the Government Took Action
According to the official statement, the CCPA found violations under the Consumer Protection Act 2019 due to the listing and sale of unauthorized wireless devices. These walkie-talkies were being sold without Equipment Type Approval (ETA), licensing documents, or frequency details, all of which are mandatory under Indian telecom laws. The government highlighted that such non-compliance not only breaks the law but could also pose security risks during heightened geopolitical tensions.
The 13 platforms served notices include Amazon, Flipkart, Meesho, OLX, TradeIndia, Facebook, Indiamart, VardaanMart, Jiomart, Krishnamart, Chimiya, Talk Pro Walkie Talkie, and MaskMan Toys.
Amazon Responds to Government Notice
An Amazon India spokesperson stated that the company operates as a marketplace and expects all third-party sellers to comply with Indian laws and Amazon’s policies. The platform emphasized that it takes corrective measures when violations are reported and is cooperating with relevant authorities to ensure compliance and consumer safety.
Government to Strengthen Compliance Guidelines
Union Food and Consumer Affairs Minister Pralhad Joshi expressed concern on social media about the risks posed by non-compliant wireless devices. He said such sales violate multiple legal frameworks, including the Consumer Protection Act, the Indian Telegraph Act, and the Wireless Telegraphy Act.
To strengthen digital marketplace compliance, the CCPA will soon issue formal guidelines under Section 18(2)(l) of the Consumer Protection Act, 2019. These guidelines aim to ensure e-commerce platforms and sellers strictly follow all applicable regulations, particularly those related to national security and consumer protection.
